Japper (japper.video) is operated by Louwr. These Terms of Service constitute a legally binding agreement between you and Louwr.

Welcome to Japper. These Terms of Service ("Terms") govern your use of our website, the Japper web application and our services (collectively, the "Service") operated by Japper ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Japper, you confirm that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into this agreement
  • You agree to comply with these Terms and all applicable laws
  • All information you provide is accurate and truthful

2. Description of Service

Japper is a digital platform that helps founders make and publish short vertical videos about their product. Our Service includes:

  • Uploading and managing footage, such as reaction clips and screen recordings
  • A brand book written with AI from the description of your product
  • AI-suggested topics, hooks and captions, and a planning calendar
  • Composing videos from your footage
  • Publishing videos to TikTok, Instagram and Facebook accounts you connect, at the times you schedule
  • User account, organization and subscription management
  • Social authentication options (Google, Apple and Facebook)

3. User Accounts and Registration

3.1 Account Creation

To use certain features of our Service, you must create an account. You may register using:

  • Your email address, signing in with a link we email to you
  • Third-party authentication services (Google, Apple or Facebook)

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials and access to your email
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account
  • Ensuring your account information remains accurate and up-to-date

3.3 Third-Party Authentication

When you use third-party authentication services (like Google, Apple or Facebook):

  • You authorize us to access certain information from your third-party account
  • You agree to comply with the third-party service's terms and policies
  • We are not responsible for the practices of third-party authentication providers

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws, regulations, or these Terms
  • Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Collect or store personal data about other users without their consent

4.2 Content Standards

All content you create or share through our Service must comply with our content policies:

  • Content must not infringe on others' intellectual property rights
  • Content must not contain malware, viruses, or harmful code
  • Content must not be spam or unsolicited promotional material
  • Content must not violate privacy rights of others
  • You must have permission from every person who appears in your footage, including people you invite to film for you

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of all content you create, upload, or share through our Service ("User Content"). By using our Service, you grant us:

  • A limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing our Service
  • The right to publish your User Content to the social media accounts you connected, but only as you scheduled it
  • The right to make backup copies of your User Content for security and service continuity
  • Permission to access your User Content as necessary to provide customer support

5.2 Our Intellectual Property

The Service, including all software, text, graphics, user interfaces, trademarks, logos, and other intellectual property, is owned by Japper and is protected by copyright, trademark, and other intellectual property laws.

5.3 Feedback

Any feedback, suggestions, or ideas you provide about our Service may be used by us without any obligation to compensate you.

5.4 AI-Generated Suggestions

Brand books, topics, hooks, captions and market research are written with the help of AI and may be inaccurate, incomplete or similar to content made for others. They are suggestions: you are responsible for reviewing them, and for everything you choose to publish.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Payment and Subscription Terms

7.1 Free and Paid Services

We may offer both free and paid versions of our Service. Paid services may include:

  • Premium features and functionality
  • More videos per month
  • Priority customer support

7.2 Billing and Payments

For paid services:

  • Payment is due in advance for the selected subscription period
  • We use Paddle as our third-party payment processor to handle transactions
  • You authorize us to charge your payment method for recurring subscriptions

7.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period.

Refund Policy (processed by Paddle):

You may request a refund within 14 days of your initial purchase by contacting us at info@japper.video. Refund requests must be submitted within this 14-day period.

8. Third-Party Platforms and Automatic Posting

Japper can publish your videos to TikTok, Instagram and Facebook. These platforms are operated by third parties and are not part of the Service.

8.1 Your Authorization

  • By connecting a TikTok, Instagram or Facebook account, you authorize Japper to publish the videos and captions you scheduled to that account on your behalf
  • You confirm that you are allowed to connect and post to that account
  • You can withdraw this authorization at any time by disconnecting the account in Japper or by removing Japper's access in the platform's own settings

8.2 When Japper Posts

  • Japper never posts without your scheduling: only videos you planned are posted, and only to accounts you connected, at the time shown in your calendar, which you can change or cancel until the post goes out
  • Before a TikTok post can go out, you choose its settings in Japper, including who can view it, whether comments, duets and stitches are allowed, and whether it is branded or promotional content. A TikTok post without these settings is not published
  • You can review and edit the caption of every post before it goes out

8.3 Your Responsibilities

  • You remain solely responsible for the content you publish through Japper, including captions written with AI
  • You must comply with the terms and policies of each platform you publish to, including TikTok's Terms of Service and Community Guidelines, and Meta's Terms of Service, Community Standards and Instagram's Terms of Use
  • You must disclose branded or promotional content where a platform or the law requires it

8.4 Availability of Platforms

We do not control TikTok, Instagram or Facebook and do not guarantee that publishing to them will be available, uninterrupted or successful. A platform may change or withdraw its API, refuse a post, limit an account, or require you to reconnect. We are not liable for posts that fail, are delayed, or are removed by a platform.

9. Service Availability and Modifications

9.1 Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. Our Service may be unavailable due to:

  • Scheduled maintenance
  • Technical difficulties
  • Force majeure events
  • Third-party service disruptions

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Service at any time. We will provide reasonable notice of material changes when possible.

10. Account Termination and Suspension

10.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features in our Service.

10.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • You fail to pay applicable fees (for paid services)
  • We discontinue the Service

10.3 Effect of Termination

Upon termination:

  • Your access to the Service will be immediately revoked
  • We may delete your account and User Content in accordance with our data retention policies
  • You remain liable for any outstanding fees or obligations

11. Disclaimers and Limitation of Liability

11.1 Service Disclaimers

Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties that the Service will be uninterrupted or error-free

11.2 Limitation of Liability

To the fullest extent permitted by law, Japper shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Interruption of business
  • Cost of substitute services

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Japper and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content, including content published to third-party platforms

13. Governing Law and Dispute Resolution

13.1 Governing Law

Dutch law applies. Disputes go to the competent court in the Netherlands, unless mandatory consumer rules point elsewhere.

13.2 Dispute Resolution

We first try to resolve any dispute together in good faith. If that does not work, the dispute goes to the competent court in the Netherlands.

14. General Provisions

14.1 Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date
  • Notify you via email or through the Service
  • Obtain your consent where required by law

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Japper regarding the Service.

14.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
